TENANCY AGREEMENT

 

A tenancy agreement is a contract between the tenant and the landlord and sets out the legal terms of the tenancy. It can be a verbal or written document that enables the tenant to live in that property on the grounds that they pay rent and abide by the rules. However, whether or not an agreement is in place, the landlord and tenant are entitled to certain right and responsibilities.


GAS SAFETY

 

It is a legal requirement for every landlord in the UK to have a Gas Safety Certificate or CP12 for all the gas appliances in the property and needs to be renewed annually. Without one you risk a large fine as well as putting your tenant at risk with the use of unsafe appliances.


ENERGY PERFORMANCE CERTIFICATE (EPC)

 

An EPC measures a property’s energy performance on a scale of A-G and is mandatory for any property that is built, sold or rented. As well as providing performance cost, this information can help tenants and landlords consider recommendations on more cost-effective measures on energy consumption.

In 2018, the EPC requirements changed, and require all privately owned properties to have an EPC rating of at least ‘E’ before it is sold or let. From April 1 st 2020, the Minimum Energy Efficiency Standards changed to apply to all existing tenancies, both old and new.


ELECTRICAL SAFETY CERTIFICATE

 

An Electrical Safety Certificate is a document issued by a qualified electrician certifying that all electrical installations, fuses and wiring are deemed safe. It is a legal requirement for all landlords to have one and to keep it regularly updated every five years.

NICEIC are the UK’s leading voluntary regulatory body for electrical contractors. They assess and approve electrician competency and are a trusted contractor for Yellands.


RIGHT TO RENT

 

Right to Rent requires every tenant to be checked for their eligibility to legally rent a residential property in England. All checks must be conducted face to face and within 28 days of starting their tenancy. Checks should be done on all adults above the age of 18 who are moving into the property, including those that are not named on the tenancy agreement.


SMOKE AND CARBON MONOXIDE ALARMS REQUIREMENTS

SMOKE ALARM

From 1 st October 2015, private landlords are required to have at least one smoke alarm fitted on every storey of their property. Landlords must ensure that they work safely at start of every new tenancy agreement.

CARBON MONOXIDE ALARM

Landlords are legally required to have a carbon monoxide alarm fitted in any room that contains a ‘solid fuel burning appliance’. Landlords must ensure that they work safely at start of every new tenancy.


INVENTORY

 

Although it is not a legal requirement, at Yellands we believe in implementing all procedures that are in the best interest of our landlords. An inventory is a comprehensive report on the property’s condition and all its contents.

We advise that a full inventory service should be carried out before the tenant moves in. If the tenant inflicts any damages to the property or leaves it an unacceptable state, the inventory will support your claim on the deposit.

Landlord Property Licensing

 

In certain parts of the country, landlords who let private residential property require a licence. Some rules relating to licensing apply across the whole of England. At Yellands Estates we can help you with your Redbridge, Newham, Waltham Forest and Havering applications wether you are one of our Landlord or not.

If a property is let without the required licence application being complete, there are very strict penalties that can be imposed. We therefore advise all clients that a licence should be in place, or an application submitted.
